1 The contract and confirmation

i. The terms and conditions set out in this section together with your booking confirmation comprise your agreement between Bedbookers.com and all the people listed on your booking, on whose behalf the party leader is acting. Bedbookers.com is a registered trademark of Bedbookers.Net Limited (registered in England 4679060), whose registered office address is, Peel House, 2 Chorley Old Road, Bolton, Lancashire, BL1 3AA, United Kingdom.

ii. We will accept your reservation when you ask for your booking to be confirmed by submitting an electronic request via our website. However, the contract is not made until the date shown on our issued booking confirmation (subject to clause 1.3). It is only then that a contract exists.

iii. Although we would not anticipate any costing errors with respect to the advertised price of accommodation and services listed on our website or on the confirmation invoice, should there be an obviously incorrect price shown, we will issue a new invoice and will not be bound by the incorrect price advertised, quoted or displayed on this website or detailed on the incorrect invoice.

iv. If you pay us any sum in order to secure a request for additional accommodation (in particular within six weeks of arrival) this constitutes a commitment to proceed with that booking once your request is confirmed and therefore such monies are non-refundable unless your request cannot be fulfilled.

v. It is important that you check all issued documentation carefully to ensure that they are correct as this forms the basis of the contract. Any discrepancies should be brought to our attention within 48 hours of issue otherwise the details shown on the confirmation invoice will be presumed to be correct.

vi. Assuming we are able to confirm your reservation, we will send a booking confirmation to you via email as soon as possible. This will be made available once we have received your booking confirmation from the hotelier or any third party service provider with whom your booking has been placed. If you do not receive a booking confirmation within 48 hours of processing your reservation you should contact our customer services team directly by telephone on 0870 741 0961 to make sure that your reservation has been accepted.


vii. In the unlikely event that we are unable to confirm your booking we will try to offer you an alternative accommodation in which case you will be free to: accept the alternative accommodation suggested by us, or: purchase another accommodation at the current advertised price from us, or: accept a full refund with respect to any monies which you have paid and have been collected by us. You must notify us of your choice in writing, preferably via email, within 48 hours of receiving our offer. If you choose to accept any alternative accommodation arrangements we will send your booking confirmation as soon as we have received your written acceptance and after we have received your alternative booking confirmation from the hotelier or any third party service provider with whom your booking has been placed. If you do not wish to proceed, we will refund any monies that you have paid to us and that we have collected within 14 days of receiving your written notification of non acceptance.

2 Holiday price

i. All reservations and prices are subject to availability at the time of processing your booking request and we reserve the right to increase or decrease our prices at any time, though the price shown on your booking confirmation will not increase, (subject to clause 1.3) or unless you amend the booking in anyway after it is made.

ii. Unless otherwise stated the total price displayed at the time of booking relates to the accommodation only price for the number of passengers allocated into the individual rooms as requested on your booking form. Your price may also include any meals with respect to the board basis which you have chosen to confirm and also includes VAT. Prices do not include any additional services such as flights, transfers or travel insurance. Prices do not include any local charges, additional taxes or incidental charges for services which you choose to undertake locally in your destination.

iii. During the season it may be necessary on certain dates to purchase extra accommodation which may mean an increase in cost being passed to you as we cannot always negotiate the same favourable seasonal rates. Such charges will be advised to you at the time of booking.

3 Cancellation and alteration by us

i. Due to the nature of travel arrangements and the fact that we plan accommodation programmes many months in advance, it is sometimes necessary to make changes to arrangements as described in this website or listed on your booking confirmation. Therefore, we must reserve the right to change or cancel travel arrangements after we have entered into the contract.

ii. If we, your hotelier or any third party accommodation provider who we are acting on behalf of makes a change or cancels your reservation then we will notify you as soon as possible. Changes can occur due to a variety of reasons including overbooking, building work, refurbishment, lack of demand, force majeure or events which are beyond our control.

iii. If we, your hotelier or any third party accommodation provider alters your booking in any way then you will be free to accept any alternative accommodation or service offered by us, your hotelier or third party accommodation provider - without compensation or, accept a replacement accommodation or service arrangement from us of an equivalent or very similar standard and price, if one is available (together with a refund of any price difference if the new arrangements are of a lower standard and price – without compensation); or cancel your accommodation arrangements with us and receive a full refund of any monies that you have paid to us and have been received by us – without any additional form of compensation or ex-gratia payment..

iv. You must notify us of your choice within 48 hours of our offer in writing, preferably via email so that we can reconfirm your alternative arrangements on your behalf or make suitable arrangements to cancel your reservation and apply a refund of any monies that you have paid to us and that have been received by us.

v. We also reserve the right as does your hotelier and third party accommodation provider, to cancel your reservation and terminate the contract immediately without any refund prior to your arrival or whilst you are in resort should we feel that your behaviour towards any of our staff, our agents, associated companies, hoteliers, third party accommodation providers, their staff or other guests staying in your accommodation be deemed to be improper or abusive.

4 Overbooking

i. In the event that your hotelier or third party accommodation provider are unable to provide the accommodation arrangements that we have reserved on your behalf and where we have not been made aware of the situation prior to your arrival in resort, you shall on arrival, be offered alternative accommodation where possible with or without some offer of compensation, which will be made to you directly by the hotelier or third party accommodation provider. You will also have the option to not accept the alternative arrangements and may cancel your reservation directly with the hotelier or third party accommodation provider and receive a refund of any monies that you have paid to us and that have been received by us with respect to your booking.

ii. If you choose to accept the alternative accommodation arrangements then you will be required to sign a disclaimer locally in resort to confirm that you have accepted any offer of alternative accommodation that has been made to you and that no further action will be taken against the hotelier, third party accommodation provider or us. This also applies to cancelling your reservation without penalty and receiving a refund of any monies that you have paid to us and that have been received by us. Failure to follow this procedure and comply with this request will result in us not being able to reclaim your refund from the hotelier or third party accommodation provider for your reimbursement.

5 Compensation

i. Any offers of compensation will be made directly to you by the hotelier or by the third party accommodation provider. Both the hotelier and the third party accommodation provider are responsible for providing your reservation and It will remain your responsibility to negotiate, secure, accept or decline any offer of compensation that may be offered to you directly by the hotelier or third party accommodation provider locally, whilst you are in resort. Should you successfully negotiate a claim for compensation directly against your hotelier or third party accommodation provider whilst you are in resort and choose to accept their offer of compensation, you will be required to sign a disclaimer locally in resort to confirm your acceptance and that no further action will be taken against the hotelier, third party accommodation provider or us. Failure to follow this procedure and comply with this request will result in us not being able to reclaim any monetary compensation from the hotelier or third party accommodation provider on your behalf.

6 Force majeure

i. We accept no liability and offer no compensation or recompense should we have to cancel or change your accommodation arrangements in any way due to war, riot, industrial or civil dispute, Airline failure, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances that may amount to Force Majeure, or that are beyond our direct control.

7 Our liability to you

i. Bedbookers.Net Limited act as retail distribution agents for third party accommodation providers who choose to distribute their inventory and products via this website and through our associated organizations and call centre. As acting retail agents our liability and responsibility to you will remain limited to the extent of passing your booking request onto your accommodation provider for confirmation. On receiving their confirmation it is our responsibility to ensure that the reservation details that you have requested are confirmed on your behalf with the third party accommodation provider with whom your reservation has been placed, subject to these terms and conditions of booking. The proper performance of accommodation services is the sole responsibility of the hotelier and the third party accommodation provider with whom your reservation has been placed.
 
ii. We shall not accept any liability to you for any loss of profits, administrative inconvenience, anticipated savings, disappointment, wasted expenditure, additional expenditure, direct or indirect loss or damage, corruption or destruction, illness, personal injury, death or loss of any kind caused or alleged to have been caused by the use of this site, the information contained herein, or the use of any service provided by us. Any claim for compensation, damages or refunds must be brought by you directly against the owner of the accommodation or the third party accommodation provider listed in the ‘ Reservation Guaranteed and Payable by’ section of your accommodation voucher and will be under the jurisdiction of the law in which the third party accommodation provider is based.

8 Content disclaimer

i. We do not guarantee the accuracy or completeness of any information contained in or provided in connection with information, accommodation or services advertised or listed within this site. The information which is displayed on this site is derived from a number of external sources and although most suppliers and content providers take great care in trying to ensure literature and content accuracy, the nature of information delivered within this site may not be free from errors or omissions and services or facilities may change or be withdrawn without our prior knowledge and this literature may also change from time to time. We strongly advise that you inquire whether any changes to the information contained in our site with respect to the accommodation and services provided have been notified to us before you book your chosen accommodation or service.

ii. We shall not accept any liability to you for any loss of profits, administrative inconvenience, anticipated savings, disappointment, wasted expenditure, additional expenditure, direct or indirect loss or damage, corruption or destruction, illness, personal injury, death or loss of any kind caused or alleged to have been caused by your use of this site, the information contained herein or otherwise presented to you through the site or the use of any service provided by us.
